Question

Asked 2/16/2012

What should he do?

My boyfriends ex was cheating on him with several men. She found one whom she moved out to live with him. She left him with all of THEIR debt and for a year and a half paid nothing on any of them. He struggled and is still struggling to make ends meet. She filed for divorce and at first wanted nothing. The Judge did not like that and made her go back and ask for now everything he doesn't have. She is able to make her own living and has a family trust to the sum of 480.000 plus no expenses with her new man. Although he is lying and saying she pays him 400.00 a month for rent. His attorney is totally incompetent but has already paid him. What possibly can this man do? He is also going to have to file for bankruptcy.

My advice to you is to get a new lawyer. I can't tell you much about his rights and things like that but I've had an experience with a bad lawyer. We had already paid him as well and opted to hang in there with him. It was a terrible decision and literally ruined our lives. So get a new lawyer!

Plus, my husband got a divorce four years ago and his lawyer wasn't terrible, but he wasn't good. Now we are suffering the effects of that. His lawyer didn't fight for better visitation and custody rights. His lawyer did not add to the conditions anything about moving away, and now she lives almost four hours away. He pays $500 a month in child support even though she's a registered nurse and makes far more than he does. There were multiple things my husband's lawyer could have done better.

So if your boyfriend doesn't get a better lawyer soon, he may very well suffer the effects for years to come as well. I hope all works out for you both, best wishes!

He has no money to pay another attorney now he is financially broke he didn't even have money to really even eat. He's been paying not only all the medical as well as all the other bills even paid her car insurance she wouldn't pay. He never wanted to cheat her out of anything but when is enough enough really??? Totally taking advantage of this situation. As well as promising their daughter a trip to Hawaii when she's done with him. So wrong in so many ways!!!!!

Thank you for the award. He has to come up with a way to get a new lawyer some how. Really, we were broke as well, completely. Knowing what I know now, and how things played out, I would have sold the house, and moved some place much cheaper just to be able to afford a new lawyer.

You can get better answers to your question as I wasn't very specific on any rights or particular things your boyfriend should make sure and fight for. If you want, you can go back and post another question, be sure and change the wording. You can post several questions about the same topic as long as they are different questions, this way you can get more detailed specific responses.

Try posting a question and explaining that they are getting a divorce, she cheated on him, she hasn't helped paying any of the debts they accrued together, and she's much wealthier than he is. Ask what his rights are or what specific things he should make sure his lawyer negotiates in regards to their debt together.

Then you can ask specific questions in regards to child support and visitation rights and so forth. You're likely to get much better information posting very specific questions. I hope this helps!

He can't sell the house we did think of that. It is underwater and in her name as well so she has no interest in that. we've been over financial's many time's and the judge is making him pay for her attorney as well. I'm thinking he is SUNK for sure. To bad in California one of the 7 deadly sins is practiced and legalized. Thank-you for your help:)
