Not divorced yet in MN & wife has boyfriend living in the house. So I agreed to leave the house since the first mort is in the wife's name and find my own place(we have been living apart for the last 12 months) 2nd mort is in both names. We have kids, 8,6,3 and she had her boyfriend move in 4 days after moving back in! I found out this was going to happen on a Thursday, the kids met this 11 year younger BF on Friday and he was moved on on Wednesday! Nothing I can really do about it but I am wondering what the court will think about this. I'm PO'd. She says he is paying $500.00 per month (which includes use of her car I guess) cause she wont be able to afford it on her own, I lived there the last year and was able to scrape by on my own and she currently makes more than I do! I have stopped paying all bills that have to do with that house since I can't see paying for anyting that this boy is using. i.e. balances in the almost ex's name for carpet, appliances, deck, ect. She totally expects me to pony up for these items which is being written up in her version of the papers. I filed and she got my papers on her B-Day last year because of a diff guy who was actually 16 years younger! (I met this one).

So where's the question? So far I think your thinking is smart and if you file for custody, she may get all tied up in knots - whether her sex life or the kids come first. I'd ask for custody and support and watch her love life crumble to pieces, then you and the kids can start all over without her.

If the court has ordered you to pay the bills/second mortgage until the divorce is final, you pay them. If they haven't, you certainly don't have to, but your credit will be effected and you could find yourself sued if your name is on the debt. That choice is up to you.
Since she now has rental income, you may want to request to have your child support recalculated. If you're filing a joint return with her, that income will have to be included on your tax return as well.

It's clear that you all don't love each other anymore so what you can do is try to speed up the divorce hearing. The bills you can stop paying for them since you no longer live with her, just keep in mind that you might have to pay for something when it is heard in court. Don't try to get back to her because there's children involved two wrong don't make a right , just keep things between you all polite if you don't have to deal with her don't.

I know student loans are rarely discharched in bankruptcy unless it would cause undo hardship to repay or if the loan went into default 7 years prior to filing for bankruptcy, both of which apply to me.
My husband is filiing for bankruptcy. i am not. i may be receiving an heritance, possibly before the discharge or soon after. will the inheritance have to be claimed to pay back his creditors if it's within the 180 days from filing? he will not be filing any joint debts.
