I live in s.c. can i be arrested if they cAN NOT FIND MY CAR. I AM TRYING TO GET MONEY UP FOR BANKRUPTCY I OLIVE IN S.C. CAN I BE arrested if they can not find my caR. I AM TRYING TO GET MONEY UP FOR BANKRUPTCY. THEY HAVE THREATENED MY CO SIGNER WITH Arrest. i have moved because i lost my house and they don't have an address on me. they have also been to my job and told my supervisor they need my cAR. WHAT CAN I DO? |

I love this. Consumer Law states it is ILLEGAL for any collection agency/finance company to threaten you with arrest when attempting to collect a past due debt. Get a lawyer, you will be able to sue them and chances are they will drop the case in your favor or have to pay you the maximum allowance for your state law. Either way, if they have threatened arrest, you will win this case. Also, if you tell them IN WRITING to stop contacting you at work, and they continue to do it.....another lawsuit. Send it in a certified return receipt letter so you know they got it. Costs about 5 dollars at the post office. I know all about consumer law, it's my passion and I have won a case similar as well.

This is what you do not want to hear. they can not arrest you or your co-borrower and they have misstated the law,but you had to have a co-signer for a reason they have something more to lose (there good credit) what you need to do is think about what is moral and right not just about yourself you borrowed the money for the car you can not pay it back so surrender the car you didnt pay for it.
when you loan someone money and they do not pay you back it makes you mad so do on to others as you wish them to do unto you. Get off this computer pick up a shovel and go to work! save your money and quit thinking about Bankruptcyor better yet if you are young pick up a rifle and go fight for our freedom, I did and I don't have problems like that anymore. Man up

Operation Repo is a bunch of bull. Don't let them scare you. If they show up at your job. You ask them to leave the premises and tell them that they are not welcomed there. If they refuse to leave, you can call the local authorities and ask them to escort them out. If you really want to be a jerk. You can ask your boss to tell them never to show up again. If they return, your boss can press charges and get them arrested for criminal trespass. You are trespassing when there is a sign stating it or when the owner asks you to leave and you refuse.

I know student loans are rarely discharched in bankruptcy unless it would cause undo hardship to repay or if the loan went into default 7 years prior to filing for bankruptcy, both of which apply to me.
My husband is filiing for bankruptcy. i am not. i may be receiving an heritance, possibly before the discharge or soon after. will the inheritance have to be claimed to pay back his creditors if it's within the 180 days from filing? he will not be filing any joint debts.
My ex husband is filing for bankruptcy we had no joint debt and he owns the house which i have moved out of. we are filing seperately for taxes. we had an agreement before he decided to file for bankruptcy to split any tx refund or tax debt. he is now telling me that the court might take his refund...
