Divorce and filing bankrupsy My wife has filed for divorce and one of her reasons is our financial situation. we are in debt for credit cards for about 50 ,000 . i have been strugling to find work. right now i am a insurance agent and making about 400.00 a month. i,ll never be able to pay what i owe and the cards were used to support our family. iknow i have to file bankrupsy its all i can do. what i,d like to know is we have a 7 year old daughter and can that fact affect my custody or joint custody of her. also my wife is making about 45,000 a year and has a company car and free gas can i get alimony from her? also what about child support? |

You cannot squeeze blood from a stone, first, your child? well, it will affect your custody ,mainly because your $400. definitely cannot raised a child, it cant even be enough for you. Second, with your wife's income you still wants alimony?, Why?, with her upkeep and her trying to care for your child, her income will be tight also, the best thing is separate amicably, talk with the wife about your child and her best interest, try to share the time with your child between you and your wife, show the child how much you two love her and best of all, file bankruptcy. And really try to get some more work....

I know student loans are rarely discharched in bankruptcy unless it would cause undo hardship to repay or if the loan went into default 7 years prior to filing for bankruptcy, both of which apply to me.
My husband is filiing for bankruptcy. i am not. i may be receiving an heritance, possibly before the discharge or soon after. will the inheritance have to be claimed to pay back his creditors if it's within the 180 days from filing? he will not be filing any joint debts.
