Chapter 7 bankrupsy and mortgage I filed personal bankrupsy our house mortgage is in both our names but the bankrupsy is just me. We want to keep our house but when we tried to pay out mortgage online bank of america would not let us. Whats up |

Until you reaffirm what debts you want to keep, B of A has no idea what the court is going to approve or not. You need to take the money into a branch and if nothing else have the manager at least put the payment in the escrow account. Theer may be some late fees tacked on but the bulk of the money can be transfered from escrow to princile and interest. I also suggest if B of A has documentation that you signed but didn't read regarding your mortgage and bankruptcy.

I know student loans are rarely discharched in bankruptcy unless it would cause undo hardship to repay or if the loan went into default 7 years prior to filing for bankruptcy, both of which apply to me.
My husband is filiing for bankruptcy. i am not. i may be receiving an heritance, possibly before the discharge or soon after. will the inheritance have to be claimed to pay back his creditors if it's within the 180 days from filing? he will not be filing any joint debts.
