Can I Sue My Morgage Company ?

In July 06 we began receiving paper work from Beverley a paralegal with McCalla,Raymer LLC stating that they represented our mortgage company Crescent Mortgage.They needed us to sign limited power of attorney over to them to convert it to real property, We have never paid a payment to this company, they sold our mortgage to US Bank before the first payment was due June 1, 2000. I tried to explain this to her and that I call our tax apprasial office and they confirmed that it was real property.

This went on for about six months, we would get a package in the front door with the same paper work. Around this same time we were informed by US Bank we were behind 3 months on our mortgage we had made Jan-Mays payment, missing Junes, and contacted them and worked out a repayment plan.

To this day we are now 6 months behind according to US Bank. In May 07 we filed bankruptcy to keep our home US BANK now claims we had not made a payment from Dec 06 - May 07.

On Nov 10, 2007 our home was destroyed by fire. I contacted US Bank to let them know of the fire. I was told then that they would be keeping the check from insurance company and it was a good idea if I shopped around for a different mortgage company.

We have since found that they have credited payments to different mortgage compay, they filed false papers in bankruptcy court and have caused by Parkinson's condition to progress and put an emoitonal and financial strange on my marraige.
