Bankruptcy & Tenant Eviction I filed an unlawful detainer against tenants on Oct 1; hearing set for Oct 16; tenant filed ch 7 bankruptcy on Oct 8. Their atty called me and said hearing would be set aside and I need not appear. I told him I would appear unless ordered not to by the court. I appeared at hearing, tenant and atty did not. Judge ruled in my favor, however, Tenn law requires 10 day period of negotiations before eviction can take place. Tenants lawyer advised me on Oct 22 that tenants would move out weekend of Oct 25-26. He also suggested I file motion to set aside judgement so that I would'nt violate bankruptcy laws. What are my options? Can I still proceed with eviction? |

I know student loans are rarely discharched in bankruptcy unless it would cause undo hardship to repay or if the loan went into default 7 years prior to filing for bankruptcy, both of which apply to me.
My husband is filiing for bankruptcy. i am not. i may be receiving an heritance, possibly before the discharge or soon after. will the inheritance have to be claimed to pay back his creditors if it's within the 180 days from filing? he will not be filing any joint debts.
